Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pioneer Poly Products, Inc. website (the “Site”) and the purchase of products from Pioneer Poly Products, Inc. (“Pioneer Poly,” “we,” “us,” “our”). By accessing the Site or placing an order, you agree to these Terms.
1) Business-to-Business Use
Pioneer Poly primarily sells to commercial customers. Some product offerings, pricing, and shipping options are designed for business-to-business transactions. You represent that you are authorized to place orders on behalf of the purchasing entity.
2) Quotes, Orders, and Order Acceptance
- Quotes (if provided) are valid only for the time stated on the quote, and otherwise are subject to change without notice.
- Your order is an offer to purchase. We may accept or reject any order, in whole or in part, at our discretion.
- An order is not considered accepted until it has been confirmed by Pioneer Poly (including via email confirmation and/or shipment).
3) Product Information
Product descriptions, images, specifications, packaging quantities, and availability may change without notice. We make reasonable efforts to display accurate information, but we do not warrant that all information on the Site is complete, current, or error-free. If a product listing contains a material error (including price), we may cancel the order and provide a refund for amounts paid.
4) Pricing, Taxes, and Payment
- All prices are shown in U.S. dollars unless otherwise stated.
- Prices may change without notice and do not include applicable taxes or shipping unless explicitly stated.
- Sales tax (or other applicable taxes) will be charged when required by law, based on ship-to location and other factors.
- Payment is due at the time of purchase unless otherwise agreed in writing (e.g., approved terms accounts).
5) Shipping, Delivery, and Risk of Loss
FOB Origin / Shipping Point: Unless otherwise agreed in writing, shipments are FOB origin (shipping point). Title and risk of loss pass to the buyer when the shipment is tendered to the carrier (i.e., when it leaves the warehouse or shipping location). Delivery dates are estimates only.
- Carrier transit times are not guaranteed and may be impacted by weather, carrier delays, and other factors outside our control.
- Shipping charges, including any accessorial fees (e.g., liftgate, inside delivery, residential delivery, limited access), may apply.
- We reserve the right to use the carrier and shipping method we deem appropriate, unless you have arranged shipping as described below.
Customer-Arranged Shipping
If you request to use your own carrier account (parcel or freight), you are responsible for all carrier charges, accessorial fees, and any disputes with the carrier. Orders using customer-arranged shipping may not ship until the shipping method and account details are confirmed. Risk of loss remains with the buyer once tendered to the carrier.
6) Inspection, Shortages, Damage, and Claims
You are responsible for inspecting products promptly upon receipt. Notify us of any shortages, damages, incorrect items, or defects within 5 business days of delivery. Photographs and documentation may be required.
- For carrier damage, you may be required to retain packaging and cooperate with carrier inspection requirements.
- Our assistance with carrier claims is provided as a courtesy and does not change FOB origin/risk of loss terms.
- Failure to report issues within the stated timeframe may limit or eliminate available remedies.
7) Returns and Refunds
Stock (non-custom) items may be eligible for return subject to approval and return instructions provided by Pioneer Poly. Unless otherwise stated in writing:
- Returns must be requested prior to sending product back.
- Returned items must be unused, in resalable condition, and in original packaging.
- Refunds are typically issued for the product price only; original shipping charges are not refundable.
- Return shipping costs are the buyer’s responsibility unless the return is due to Pioneer Poly’s error.
- A restocking fee may apply for certain returns (we will communicate if applicable).
Custom or Made-to-Order Products
Custom, made-to-order, or special-order products are non-cancelable and non-returnable once production has started, except in cases of confirmed manufacturing defect or non-conformance to agreed specifications.
8) Quantity Variances for Custom Production
For custom or made-to-order products, Buyer acknowledges that manufacturing processes may result in reasonable overages or shortages relative to the ordered quantity. Buyer agrees to accept and pay for the actual quantity produced and delivered.
Applicable production tolerances will be communicated prior to order placement and may vary based on product specifications, material type, and production method. Final invoicing will reflect the actual quantity delivered.
9) Cancellations
- Stock orders may be cancellable prior to shipment, subject to processing status and supplier constraints.
- Custom or made-to-order orders may not be cancelled once production has started.
- If an order is cancelled after fulfillment has begun, fees may apply (including shipping, handling, and supplier costs).
10) Limitation of Liability
To the fullest extent permitted by law, Pioneer Poly will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, or business interruption) arising out of or related to the use of the Site or products purchased, even if advised of the possibility of such damages.
Pioneer Poly’s total liability for any claim shall not exceed the amount paid for the specific products giving rise to the claim.
11) Warranty Disclaimer
Except as expressly stated in writing, products are provided “as is” and “as available.” We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
12) Compliance and Intended Use
You are responsible for determining product suitability for your intended application, including regulatory compliance, storage conditions, and performance requirements. Where products are described as “FDA compliant” or “food safe,” such descriptions refer to supplier-provided information and applicable resin/material standards, and do not constitute a guarantee for all end-use conditions.
13) Force Majeure
Pioneer Poly is not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disruptions, supply shortages, carrier delays, war, terrorism, governmental actions, power outages, or internet/technology failures.
14) Intellectual Property
The Site content (text, graphics, logos, images, and layout) is owned by or licensed to Pioneer Poly and may not be copied, reproduced, or distributed without our prior written permission, except as allowed by law.
15) Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site or purchases after changes become effective constitutes acceptance of the updated Terms.
16) Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Minnesota, unless otherwise required by law.
